Terms of Service

1. Acceptance of Terms

By creating an account, accessing, or using Memsight (“the Service”), you agree to be bound by these Terms of Service. The Service is operated by Galore Interactive (“we,” “us,” “our”). If you do not agree to these terms, do not use the Service.

2. Service Description

Memsight is a runtime intelligence platform that provides:

  • Natural language queries over live application state
  • AI-powered interpretation and insights
  • Real-time streaming of runtime data
  • A composable query language for structured access to application state
  • An expertise packs marketplace for community-created diagnostic knowledge
  • Runtime SDKs for multiple platforms

The Service is designed as a development and diagnostic tool. The runtime SDK reads application state but never modifies it. See Section 6 for details.

3. Accounts and API Keys

To use the Service, you must create an account with a valid email address and password. After account verification and setup, you can generate an API key that authenticates your runtime SDK with the Memsight cloud service.

You are responsible for maintaining the security of your account credentials and API key. Do not share your API key publicly or commit it to version control. If you believe your API key has been compromised, you can regenerate it from your account settings.

You are responsible for all activity that occurs under your account.

4. Credits and Billing

The Service uses a credit-based billing model. Credits are consumed when the cloud service processes queries, generates insights, or performs AI-powered analysis.

Subscription tiers

  • Trial: 15,000 one-time credits for 14 days, no payment required
  • Basic: $9.99/month, 100,000 credits
  • Pro: $29.99/month, 500,000 credits
  • Enterprise: $99/month, 2,000,000 credits

Credit policies

  • Subscription credits reset at the beginning of each billing cycle. Unused subscription credits do not roll over.
  • Additional credits may be purchased on-demand at $0.02 per 1,000 credits. On-demand credits do not expire.
  • We will notify you when you are approaching your credit limit.

All payments are processed through Stripe. By subscribing, you authorize Stripe to charge your payment method on a recurring basis. You may upgrade, downgrade, or cancel your subscription at any time. Changes take effect immediately with prorated billing.

5. Acceptable Use

You agree to use the Service only for its intended purpose: development, debugging, and diagnostic tooling. You may not:

  • Use the Service to attack, exploit, or compromise other systems or users
  • Attempt to reverse engineer, decompile, or disassemble the Memsight cloud service
  • Use automated means to scrape, crawl, or extract data from the Service beyond normal API usage
  • Resell, sublicense, or redistribute access to the Service without written permission
  • Upload malicious content to the expertise packs marketplace
  • Circumvent rate limits, credit limits, or other usage controls
  • Circumvent SDK/package edition entitlements (including attempts to unlock paid-only Memsight features without a valid paid license)
  • Submit false, misleading, or unauthorized purchase-claim evidence for entitlement or credit grants

6. Runtime Instrumentation

The Memsight runtime SDK operates under two architectural guarantees:

  • Observe only. The SDK reads application state. It never writes to, modifies, or mutates the state of the running application, its memory, or its behavior.
  • Development-only by default. The SDK is excluded from release builds by default. The instrumentation code is stripped at compile time, resulting in zero runtime cost and zero attack surface in production. You may explicitly opt in to include the SDK in release builds if your use case requires production observability.

These guarantees are architectural decisions, not configuration options. The SDK does not contain functionality to modify running application state regardless of configuration.

7. SDK License and Asset Entitlements

Your use of the Memsight SDK is also governed by the Memsight End User License Agreement (“SDK EULA”), available at /memsight/eula. The SDK EULA is incorporated into these Terms by reference.

  • Memsight Lite and Memsight (Paid) are distinct package editions with different feature entitlements.
  • Cloud subscription status does not grant paid SDK/package edition features by itself.
  • Unity Asset Store purchase claims may require manual verification and supporting evidence.
  • One-time launch-credit grants tied to verified purchases are non-transferable, non-refundable, and limited to verified entitlements.

8. Intellectual Property

The Memsight platform, including the cloud service, runtime SDKs, query language, documentation, and website, is the intellectual property of Galore Interactive. All rights reserved.

You retain full ownership of your application code, your query data, and any insights generated from your data. We do not claim any rights to your application state, query history, or diagnostic results.

9. Expertise Packs

The expertise packs marketplace allows users to create, publish, and share diagnostic knowledge modules. If you publish an expertise pack:

  • You retain ownership of the content you create
  • You grant Galore Interactive a license to host, distribute, and display your pack within the marketplace
  • You represent that your pack does not contain malicious instructions, misleading claims, or content that violates these terms

We reserve the right to remove or delist expertise packs that violate these terms, contain harmful content, or are reported by the community.

10. Data Handling

When you use the Service, queries may include information about your application's runtime state. This data is processed by the Memsight cloud service to generate insights and is subject to our Privacy Policy.

We do not sell your data. We do not share your query data or application state with third parties. Query data is processed for the sole purpose of providing you with insights and is retained according to the policies described in our Privacy Policy.

AI-powered features (translation, interpretation, insight generation) may use third-party language model providers to process queries. These providers process data according to their own data handling agreements and do not retain query data for training purposes.

11. Limitation of Liability

The Service is provided “as is” without warranty of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or that insights generated will be accurate or complete.

To the maximum extent permitted by law, Galore Interactive shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising from or related to your use of the Service.

12. Termination

You may close your account at any time from your account settings. Upon termination, your access to the Service will end and any remaining subscription credits will be forfeited. On-demand credits are non-refundable.

We may suspend or terminate your account if you violate these terms, engage in abusive behavior, or if required by law. We will make reasonable efforts to notify you before termination except in cases of severe violations.

13. Changes to Terms

We may update these terms from time to time. Material changes will be communicated via email or a prominent notice on the Service. Your continued use of the Service after changes take effect constitutes acceptance of the updated terms.

14. Governing Law

These terms are governed by the laws of the State of Georgia, United States, without regard to conflict of law principles. Any disputes arising from these terms shall be resolved in the courts of Cobb County, Georgia.
